SAN JOSE, Calif. (KION-TV) UPDATE MAY 16, 2022, at 10:21 a.m.- Former UFC star Cain Velasquez pled not guilty in court Friday to attempted murder charges in a Santa Clara County courtroom.
He is accused of trying to kill Harry Goularte, who is suspected of molesting a 4-year-old relative of Velasquez.
“Mr. Velasquez’s conduct on that day of his encounter with Goularte was the result of being severely provoked by seeing Goularte freely out in the community to continue to abuse other children,” Velasquez's attorney wrote in court documents.
Goularte is charged with molesting the relative “hundreds of times” at a daycare owned by his mother, Patricia Goularte, court records said.
A 5-day preliminary hearing for Velasquez will begin on September 26 to see if prosecutors have enough evidence to move the case to a trial.

UPDATE MAY 16, 2022, at 10:21 a.m.-- Former UFC Champion Cain Velasquez was denied bail for the second time in court on Monday.
He is accused of trying to kill a man that is suspected of molesting a 4-year-old relative of Velasquez.
Santa Clara Superior Court Judge Sheylna Brown said that "the court is not ruled by community opinion at all... It is ruled by the law," according to our Fox affiliate.
Brown also said that what Velasquez did was a "reckless disregard for human life," according to our Fox affiliate.
If convicted, Velasquez faces 10 assault and weapons-related charges that could bring him 20 years of jail time. In March, he was first denied bail and is in custody at the Santa Clara Main Jail.
UPDATE APRIL 12, 2022 at 10:10 a.m.-- Former UFC Heavyweight Champion Cain Velazquez has released his first public statement since being arrested for the attempted murder of a man charged with felony child molestation.
UPDATE MARCH 7, 2022, at 12:29 p.m.-- A judge denied bail for former UFC Heavyweight Champion Cain Velasquez on Monday for the attempted murder of a man charged with felony child molestation.
Velasquez's attorney asked the judge for bail to be set so the former MMA fighter could see his family but the judge refused and said the "risk is too great" for public safety, and for the family of the sexual assault suspect Harry Goularte.
A plea to Velasquez's charges was carried over for a hearing on April 12.
UPDATE MARCH 3, 2022 at 6:12 p.m.-- Former UFC Heavyweight Champion Cain Velasquez is scheduled to be arraigned at 1:30 p.m. for the attempted murder of a man who is charged with molesting Velasquez's close family member.
Velasquez, 39, fired a handgun several times at a truck carrying Harry Goularte, 43, and two older relatives, then rammed the truck with his own truck, law officials said.
Velasquez began shooting at the victims at Cochran Road and Butterfield Boulevard in Morgan Hill around 3 p.m. Monday.
According to the Santa Clara District Attorney's Office Velasquez then followed the victims' vehicle, being driven by Goularte's stepfather, in his Ford truck.
During an 11-mile, high-speed chase through San Jose, Velasquez rammed his truck into the victims' Chevrolet Silverado and fired several shots from his registered .40 handgun.
The female passenger in the Silverado called 911 for help.
Velasquez was stopped and arrested by Morgan Hill police near Madrone Avenue.
Goularte's step-father was hit in the arm and torso and went to the hospital with non-life-threatening injuries.
Velasquez is charged with attempted, premeditated murder, and other related charges and could be incarcerated if convicted.
“The sad tragedy is that Mr. Velasquez chose to take the law into his own hands, endangering the public and everyone in the truck,” Santa Clara District Attorney Jeff Rosen said. “This act of violence also causes more pain and suffering to his family.”
Goularte is facing felony charges of child molestation and was arraigned in Santa Clara County Superior Court on February 25.
A judge released Goularte without bail under the condition that he stays in home detention in Morgan hill and stays 100 yards away from children under 14 and wears an ankle monitor.
Goularte was on his way to get the monitor when Velasquez attacked.
Goularte was arrested on Feb. 25 after allegedly molesting a child at a daycare that was based at Goularte's home.
Velasquez is expected back in court on Monday for further arraignment.
On Monday the San Jose Police Department was sent to Monterey Highway and Bailey Avenue on reports of a shooting.
Former UFC Heavyweight Champion, and Salinas-born, Cain Velasquez was arrested on suspicion of being involved with the shooting that left one male shot at least once, according to police.
Police said the victim was taken to the hospital for non-life threatening injuries.
Velasquez was booked into Santa Clara County Jail for attempted murder.
The motive for the shooting is still unknown and is being investigated at this time.
Velasquez is scheduled for further arraignment on Monday.
