Civil rights attorney to review case involving Hollister PD
A prominent Bay Area-based civil rights attorney said he’s willing to look at a case involving Hollister police and a recent suspect.
Attorney John Burris said family members of Ery Hernandez, 27, are considering legal action against the Hollister Police Department.
This comes after an incident Monday night when Hollister police said Hernandez showed up at San Benito County Juvenile Hall, claiming he and his family were in danger.
During the interaction, police said they tried to help Hernandez but he appeared to be under the influence of drugs and became combative with officers.
Hollister police said Hernandez kicked and punched officers, while they tried to user a Taser and pepper spray to safely take him into custody. But neither were effective. They also said Hernandez pulled a radio from one officer, tore their uniform and grabbed his utility belt.
Officers said they ended up using a baton to get him under control and took him to the hospital for an evaluation.
Burris said he’ll be reviewing the Hernandez case for any possible civil rights violations.
Family members said Hernandez still in the hospital. Hollister police said the department can’t comment on the matter.
