Inmate asks court to block second nitrogen execution in Alabama
MONTGOMERY, Ala. (AP) — Lawyers for an Alabama inmate have asked a judge to block the nation’s second scheduled execution using nitrogen gas, citing what happened at the first. Alan Eugene Miller is scheduled to be executed on Sept. 26. His attorneys have argued the first nitrogen execution in January left Kenneth Smith shaking and convulsing on a gurney for several minutes as he was put to death. Miller’s attorneys have asked a federal judge for a preliminary injunction to stop the execution from going forward, or to at least require the state make changes to the protocol.
