Supreme Court refuses to hear Morgan Hill students’ appeal
The U.S. Supreme Court has denied an appeal from former Live Oak High School students who were ordered to turn their American flag t-shirts inside out during a Cinco de Mayo celebration.
That leaves a lower court ruling in place, which found that school officials acted appropriately because their concerns about racial violence outweighed students’ freedom of expression rights.
At a school rally in 2010, administrators feared that the American flag shirts would cause problems with Latino students celebrating the Mexican holiday.
Morgan Hill students argued that school officials gave a “heckler’s veto” to the objecting students.
